These Terms of Service govern your use of this website and of the text messaging program operated by Affinity Underground Utilities Concrete Construction LLC (“Affinity Utilities,” “we,” “us” or “our”). By using the site, submitting the estimate request form, or receiving text messages from us, you agree to these terms.

If you do not agree with them, please do not use the site or opt in to our messages. Your use of the site is also governed by our Privacy Policy.

We provide concrete construction and underground utility services for residential and commercial properties in Cincinnati, Ohio and the surrounding region.

Submitting the estimate request form is a request for an estimate. It does not create a contract, reserve a place on our schedule, or obligate either of us to anything. Any work we perform is governed by the separate written estimate or contract you and we sign for that project — not by this website.

These terms apply to text messages sent by Affinity Underground Utilities Concrete Construction LLC to the mobile number you provide.

Program description and use cases

We operate two separate message programs, and you consent to each one independently. Transactional messages relate to work you have asked us about or hired us for:

• Estimate and appointment confirmations
• Scheduling changes and crew arrival updates
• Project status notifications while work is underway
• Service follow-ups after a project is finished

Marketing messages, if you separately consent to them, may include:

• Seasonal concrete maintenance reminders
• Sealing and power-washing reminders
• Special offers and promotions

How to opt in

You opt in by checking one or both of the consent boxes on our estimate request form, or by texting us first at 513-546-4690. Both boxes start unchecked and both are optional. Consent to receive text messages is not a condition of any purchase or of receiving an estimate. Checking the marketing box is never required, and declining either one does not affect the service you receive.

Message frequency

Message frequency may vary. It depends on your project and generally increases around scheduled work, then stops when the project is finished. Marketing messages, if you opted into them, are occasional and seasonal.

Message and data rates

Message and data rates may apply. Any charges are set by your mobile carrier under your own plan, not by us. Check with your carrier if you are unsure what your plan includes.

How to opt out

You may also opt out by calling 513-546-4690 or emailing lawill57@yahoo.com. If you want to stop marketing messages but keep receiving updates about your project, tell us — the two are separate and we can adjust either one. If you later want to rejoin, you will need to opt in again.

Carriers and delivery

Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your mobile carrier and is outside our control. We cannot guarantee that every message will arrive, or that it will arrive at any particular time, and neither we nor your wireless carrier are responsible for messages that are delayed, undelivered or misdirected. Message services are not supported by every carrier or on every device.

Eligibility

You must be at least 18 years old to consent to receive text messages from us. By opting in, you confirm that you are 18 or older and that you are the account holder for the mobile number you provided, or that you are authorized by the account holder to consent on their behalf. Do not provide someone else’s number without their permission. If your number changes or is reassigned, please tell us so we can update our records.

Privacy

Your mobile number and your consent are handled as described in our Privacy Policy. In particular, see We Do Not Share Your SMS Opt-In Information: mobile information is never shared with third parties or affiliates for marketing or promotional purposes.

You agree to use this site lawfully and honestly. Specifically, you agree not to:

• Submit false, misleading or fraudulent information through our forms
• Provide a phone number you do not own and are not authorized to give us
• Use the site or our contact details to send spam, solicitations or bulk messages
• Attempt to gain unauthorized access to the site, its hosting, or any connected system
• Interfere with the site through automated scraping, overloading, or similar activity
• Use the site for any unlawful purpose or in violation of these terms

We may decline to respond to, or may remove, any submission that appears to breach these terms.

The content of this site — text, layout, logos, and project photography — belongs to Affinity Underground Utilities Concrete Construction LLC or is used with permission, and is protected by copyright and trademark law. You may view and print pages for your own use in evaluating our services. You may not republish, resell or redistribute site content, or use our name or logo, without our written permission.

Service descriptions, photographs and other information on this site are provided for general reference. Photographs are illustrative of the type of work we do and are not a promise of a specific result on your property. We work to keep the site accurate but do not warrant that it is complete, current or error-free.

Pricing, scope, materials and schedule are established in a written estimate for your specific project. Where anything on this site conflicts with your signed estimate or contract, the signed document governs.

This site is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, to the fullest extent permitted by law.

To the fullest extent permitted by law, Affinity Underground Utilities Concrete Construction LLC is not liable for any indirect, incidental, special or consequential damages arising from your use of this website, from any inability to use it, or from any delayed, undelivered or misdirected text message. Nothing in this section limits our responsibility for work we actually perform under a signed estimate or contract, or any liability that cannot be limited under applicable law.

These terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law rules. Any dispute arising out of these terms or your use of this site will be brought in the state or federal courts located in Hamilton County, Ohio, and you consent to the jurisdiction of those courts.

We may update these Terms of Service from time to time. When we do, we will post the revised version on this page and update the effective date at the top. Changes take effect when posted, and your continued use of the site after that means you accept them. Changes to the text messaging program will be reflected here and in our Privacy Policy.
